HP, in partnership with Freshfields, emerged victorious in a legal battle defending its printer cartridges in Munich. The dispute involved Ninestar subsidiary CaiLuo Technology, which faced a sales ban after losing the case against HP at Munich Regional Court.
The conflict centered on printer cartridge technology, with Hewlett Packard Development taking legal action against various European and Chinese companies of the Ninestar Group, including CaiLuo. The latter was accused of infringing HP’s patented technology with its Doreink brand printer cartridges.
The recent ruling focused on a specific patent titled “Partition Map,” safeguarding a partition table optimizing printing parameters in the cartridge storage device. The court found CaiLuo guilty of patent infringement concerning printer cartridge models 963 XL and 912 XL, leading to a cease-and-desist order, product destruction, and damages payment.
CaiLuo, a subsidiary of Ninestar Corporation, a major printer cartridge manufacturer, had been selling the infringing cartridges under the brand name “Doreink” on platforms like Amazon. Despite the ruling, the defendant plans to appeal the decision, indicating potential further legal proceedings.
HP had filed multiple patent infringement suits against CaiLuo, with ongoing cases involving various patents at Munich Regional Court. Apart from the successful verdict on EP 2 335 120, other patents like EP 3 530 470, EP 3 688 602, and EP 3 183 121 were also part of the legal disputes.
Notably, Freshfields spearheaded the legal representation on behalf of Hewlett-Packard Development, with a team led by partners from Düsseldorf and Berlin offices. The case involved technical advice from patent attorneys, emphasizing the complexity and expertise required in patent litigation.
